| Tóm tắt/chú giải | International Investment Law Reconciling Policy and Principle offered an analysis of fundamental principles in international investment law and the trends in interpretation of the mentioned principles in case law from the past to present. This book indicated the author's perspective on the emerging of current international instruments such as customary international law, bilateral investment treaty (BIT), free trade agreement (FTA) governing the protection of foreign investment for the promotion of sustainable development. By examining the evolution of international investment law, the author gave an account of the current debate in international investment law relating to the inconsistency in the legal framework regulating foreign investment, in particular, the imbalance between investor’s rights and a host state’s police powers to regulate in the public interest. Structurally, the book has been divided into 7 chapters in order to address 4 following key issues: the shifting landscape of international investment law, the protection of foreign investment through various standards of treatment, some of the challenges arising from the implementation of international investment treaties and the recommendations to tackle the mentioned issues. In the first chapter of this book, the author briefly refered to the formation and development of foreign investment law in response to changing economic and political situations of the world. This chapter discussed the debatable issues relating to the main purpose of the origin of this law by providing two theory: The Hull formular (developed countries) and the Calvo doctrine (developing countries). Then, chapter two continued to show the international efforts to regulate foreign investment under the auspices of UN, The Bretton Wood Institutions and other economic organizations. Despite the huge growth in international investment treaties, free trade agreement and other multilateral agreements as well as the need for an international investment agreement, there is no global treaty on foreign investment yet. Chapter three examined some standards of treatment of foreign investment by referring the minimum standards of treatments in customary law
