| Tóm tắt/chú giải | Human Rights Law creates controversy, contention and counter-point like few other legal areas. Human Rights and Civil Liberties is a clear and comprehensive guide to this rapidly developing subject, and covers the enforcement of human rights and civil liberties generally, before examining the protection of specific areas of civil liberties in domestic law including (among others): the right to life, freedom of expression; the right to demonstrate; privacy; and freedom from torture. The book places the study of the subject within the context of the passing and implementation of the Human Rights Act 1998 and the principles and case law of the European Convention on Human Rights, providing you with an unrivalled framework to deepen your understanding of the area. This volume contributes to the on-going legal discussion on pressing procedural and substantial law issues in the ambit of international human rights and civil liberties. While the 20th century has seen the true awakening of human rights, the 21st century poses new challenges to this ever-unfolding area of law. Not only do international tribunals and quasi-tribunals worldwide and domestic US and European continental courts have to deal with increasing numbers of complaints and petitions from individuals and groups on a vast array of societal problems, the legal issues put to them are sometimes extremely difficult to resolve as they relate to very sensitive issues. This book examines issues ranging from the status of human rights under US law to the status of the ECHR in the broader context of international law. It looks at the role of positive obligations in the case law of the Strasbourg Court, as well the impact of its case-law on childbirth and push-back operation towards boat people, but also at the growing unwillingness of ECHR member states to cooperate with the Strasbourg Court. It explores the new frontiers in US Capital punishment litigation, the first case before the International Criminal Court and the legal effect of judgments of the European Court on third states. The study of and interest in human rights and civil liberties has grown trmendously over the past two decades, particularly since the implementation of the Human rights Act 1998. As a result, a great number of specific human rights courses are taught on undergraduate programmes and most constitutional law courses are dedicating more time and space to human rights issues. In addition, human rights have become central to the law student’s study and pervade much of their law studies, not only in constitutional law, but also in areas such as tort, crminal law, and even business law and property subjects, where the student needs to be aware of the impact of the 1998 Act.The central aim of this book is to provide clear guidance on how to tackle questions, both in essay and problem question form, on human rights and civil liberties. The author has attempted to cover as many aspects of human rights, their protection in domestic and international law, and the protection of specific human rights such as the right to life, freedom, form toture, freedom of expression, the right to association nd peaceful assembly, the right to privacy, the right to a fair trial, liberty and securityof the person and prisoner’s rights. Issues relating to freedom discrimination are covered in chapters on the European Convention on Human rights, private life and freedom of Association, assembly and religion. Chapters on the human rights act, the European convention, and freedom of Association also contain questions on the very topical rights as opposed to social and economic rights, mainly because these are rights protected under the European Convention on Human rights and the coverage of human rights issued under the European Convention on Human rights and the coverage of human rights issues on most, though not all, human rights courses in undergraduate programmes
